Can you sell your HDB flat before the MOP?
Not on the open market. Under HDB's resale terms, an Option to Purchase granted before you meet the Minimum Occupation Period is null and void. The MOP is 5 years for most flats and 10 years for Plus and Prime flats. HDB may approve an early sale as an exception, assessed case by case.
HDB defines the MOP as the period you must physically reside in your flat. The count starts from the legal completion date of your purchase. It leaves out any period when you did not physically live there, so your MOP date can fall later than a simple count from completion.
How long the MOP runs for each type of flat
HDB sets the length by how you bought the flat, its classification and the date of the flat application. These are the periods on HDB's selling eligibility page, checked on 22 October 2026.

| How you bought the flat | MOP |
|---|---|
| From HDB, unclassified or Standard flat | 5 years |
| From HDB, Plus or Prime flat | 10 years |
| Resale on the open market, unclassified or Standard flat | 5 years |
| Resale on the open market, Plus or Prime flat | 10 years |
| DBSS flat bought from the developer | 5 years |
| Fresh Start Housing Scheme | 20 years |
HDB calls flats sold before the October 2024 sales exercise unclassified. They follow the 5-year rule. Prime flats include Prime Location Public Housing (PLH) flats sold before that exercise, so an older PLH flat carries the 10-year MOP.
Buying a resale flat starts a new count for you. HDB's resale terms, updated 7 September 2026, require the buyer's household to occupy the flat for the minimum occupation period from the resale completion date. Years the previous owner spent there do not shorten yours.
For a flat bought from HDB, HDB says you become the flat owner after key collection. Do not count from your booking or from the Agreement for Lease. Use the MOP date that HDB shows you.
SERS replacement flats have their own wording. For SERS sites announced on or after 7 April 2022, HDB says you may sell the replacement flat only after 5 years from collecting the keys. Older sites have different options, so read HDB's SERS rules for your case.
What the MOP stops you doing
The MOP is not only a sale rule. For an unclassified or Standard flat, HDB says everyone listed must physically reside in the flat for 5 years before they may do any of these:
- Apply for an HDB Flat Eligibility (HFE) letter, which HDB requires before you buy another HDB flat.
- Sell the flat on the open market.
- Rent out the whole flat.
- Acquire an interest in private property, in Singapore or overseas.
Plus and Prime owners face a stricter rental rule. HDB does not allow them to rent out the whole flat at all, even after the 10-year MOP.
Time that does not count towards the MOP
HDB excludes any period when you do not physically reside in the flat. Its examples are a whole-flat rental with HDB's prior approval and a period when the flat lease has been infringed. HDB's resale terms give it sole discretion over how the period is computed.
Not living in the flat is a problem in itself. HDB says non-occupation is an infringement of the Housing and Development Act, for which it can compulsorily acquire the flat. Moving out early and waiting for the date to pass is not a safe plan.
A change of owners can bring its own occupation requirement. HDB's terms for a change in flat ownership (not through a sale) say incoming owners must fulfil a requisite occupation period before they may sell. Ask HDB before you add or remove an owner close to your target sale date.
When HDB may approve a sale before the MOP
HDB treats an early sale as an exception, not a right. Its selling page is specific about divorce. If the MOP has not been met, HDB asks you to write in with your divorce documents. It says it will assess your situation and contact you.
In January 2020, the Ministry of National Development told Parliament that HDB had approved some early sales. The reasons included financial hardship, divorce and the death of the owner. It said approvals are given case by case, after HDB assesses the circumstances of the owners and their families.
Paperwork comes first in both situations. HDB asks owners going through a divorce to settle the proceedings before registering an Intent to Sell. Where an owner has died, it asks for a Grant of Probate or Letters of Administration from the courts first.
If money is the problem, talk to HDB early. For HDB loans it offers Financial Assistance Measures, such as paying arrears by instalments or reducing or deferring instalments for a continuous 6-month period. Its longer-term suggestions include renting out spare bedrooms, adding working family members as joint owners, and selling to right-size. You apply by booking an appointment at the HDB Branch managing your flat. If your loan is from a bank, HDB advises approaching the bank early.
The HDB pages we checked do not list standard conditions for an approved early sale. Ask HDB to confirm in writing what would apply before you plan around it. An approved early sale may also fall inside the Seller's Stamp Duty holding period. IRAS sets it at up to 4 years for residential property bought on or after 4 July 2025.
Find your own MOP date
Log in to MyHDB Page with Singpass. Go to My Flat, then Purchased Flat, then Flat Details and Minimum Occupation Period (MOP). HDB says this shows whether you have met the MOP to sell your flat.
Registering an Intent to Sell in My Flat Dashboard on the HDB Flat Portal also tells you when you may start to grant an Option. Treat it as an indication. HDB says the result is not its approval to sell, which it decides after receiving the resale application.
Keep a copy for buyers. HDB notes that buyers may ask for proof that you can sell. A printout from MyHDB Page showing you have met the MOP is one of the documents it suggests.
Plan the listing so the Option falls after the MOP
HDB's rule bites on the Option, so work backwards from the first day you could sign one. That day is the later of your MOP date and the end of the 7-day wait after you register your Intent to Sell.
- Confirm your MOP date on MyHDB Page and settle your next home first. HDB asks sellers to plan their next housing before putting the flat on the market.
- Register your Intent to Sell personally. HDB says a salesperson cannot register it for you, and that sellers must register before they put the flat on the market.
- Check the date the Intent to Sell gives for granting an Option. HDB's pages do not say whether you can register before your MOP ends, so rely on what the system shows you.
- Keep the 12-month validity in view. The Intent to Sell must still be valid when you grant the Option and when you submit the resale application.
- Tell interested buyers the earliest Option date in writing, and only sign an Option dated on or after it.
Common questions
Not on the open market. HDB treats an Option to Purchase granted before the MOP as null and void. It may approve an early sale as an exception, for reasons such as financial hardship, divorce or the death of an owner, and assesses each case.
Five years for an unclassified or Standard resale flat, counted from the resale completion date. A resale Plus or Prime flat has a 10-year MOP.
HDB counts the MOP from the legal completion date of your flat purchase, not from booking. For a resale flat that is the resale completion date. Check the exact date HDB holds on MyHDB Page.
Not the whole flat. HDB allows whole-flat rental only after the MOP and with its approval, and Plus and Prime owners cannot rent out the whole flat at all. Renting out spare bedrooms has separate rules and needs HDB's approval.
HDB says you must register an Intent to Sell before putting the flat on the market. An Option can only be granted once the MOP is met, so plan for any accepted offer to be signed on or after that date.
Log in to MyHDB Page and go to My Flat, Purchased Flat, then Flat Details and Minimum Occupation Period (MOP). Registering an Intent to Sell also shows when you may start to grant an Option.
